The analytical framework

Define the benchmark. Apply the record. State the limits.

A property-management standard-of-care analysis should explain what a reasonably prudent operator would establish under comparable circumstances, identify the sources supporting that operational benchmark, and then apply the facts reflected in the record. The resulting opinion should remain understandable to counsel, the court, and the factfinder.

My framework draws on 23 years of commercial and multifamily operating experience, management agreements, documented policies, accepted operational controls, professional education, and the specific conditions presented by the property and assignment.

Operational systems commonly examined

  • Governance, delegated authority, staffing, training, and supervisory review.
  • Inspection programs, preventive maintenance, work-order controls, and exception reporting.
  • Resident, tenant, owner, vendor, and emergency communication protocols.
  • Vendor selection, contracting, insurance, access, supervision, and completion verification.
  • Incident response, evidence preservation, post-incident review, and corrective action.
  • Recordkeeping sufficient to show notice, assignment, escalation, action, and closure.

How I apply the record

I organize the documents chronologically, identify who held each operating responsibility, compare written procedures with testimony and contemporaneous records, and test whether the system was capable of recognizing and closing the condition at issue. Findings distinguish documented facts, reasonable operational inferences, disputed facts, and information that remains unavailable.

A credible standard-of-care opinion is specific enough to be useful, supported enough to be tested, and disciplined enough to stop at the edge of the expert’s actual field.

Explicit non-opinions

I do not tell the factfinder what the law requires or who should prevail. Legal duty, breach, negligence, causation, liability, statutory interpretation, code interpretation, engineering, medical issues, and forensic reconstruction remain outside a property-management standard-of-care opinion.
