Commercial property claims often turn on how ownership responsibilities were translated into day-to-day operating practices. I evaluate the management agreement, staffing structure, inspection routines, work-order process, vendor relationships, tenant communications, and supervisory controls reflected in the record.
Assignments may involve office, retail, mixed-use, or other professionally managed commercial assets. The analysis is grounded in what a reasonably prudent property operator would establish, communicate, document, escalate, and verify.
Questions I evaluate
- Whether the management agreement and operating procedures assigned responsibility clearly.
- Whether inspection routes and exception logs were designed to identify abnormal conditions.
- How maintenance requests, service tickets, and tenant reports moved from notice to closure.
- Whether vendors were appropriately scoped, insured, supervised, and verified after work.
- Whether site and regional personnel had workable escalation and reporting protocols.
- Whether capital work and temporary conditions were coordinated around occupants and visitors.
Records commonly reviewed
Relevant materials may include property management agreements, leases, operating policies, inspection records, work orders, preventive-maintenance schedules, vendor contracts, certificates of insurance, incident reports, photographs, communications, training materials, staffing records, deposition testimony, and post-incident corrective-action documents.
The operational question is not simply whether a task was missed. It is whether the management system was reasonably designed to detect, assign, escalate, document, and close the condition at issue.
Scope of opinion
I address commercial property-management practices and the application of those practices to the available record. I do not offer legal conclusions about duty, breach, negligence, causation, or liability, and I reserve code interpretation, engineering, forensic reconstruction, and security-tactics opinions to appropriately qualified professionals.
