Premises safety depends on a working management system.
An office-building incident can involve an isolated condition, but the property-management analysis is broader: Was the condition reasonably detectable? Who was expected to act? Was an interim protective measure available? Was the issue referred to the right party, escalated when necessary, and tracked to verified completion?
I evaluate those questions from the perspective of an experienced commercial property operator, including matters involving exterior common areas, entrances, sidewalks, parking areas, service zones, tenant-accessible spaces, and equipment controlled by third parties.
Questions I evaluate
- Whether inspection routes and frequencies matched the property’s use and known conditions.
- How employees were expected to recognize and document an abnormal condition.
- Whether warnings, barriers, temporary controls, or access restrictions were considered.
- How ownership, tenants, contractors, utilities, or other third parties were notified and coordinated.
- Whether assignments had deadlines, escalation triggers, and supervisory follow-up.
- Whether the record shows verification of correction rather than assumption of completion.
Records commonly reviewed
The relevant record may include the management agreement, site plans, inspection forms, daily logs, work orders, photographs, surveillance references, emails and text messages, vendor records, tenant reports, incident documentation, deposition testimony, and post-incident changes to procedures or physical conditions.
A reasonably designed process moves through detection, documentation, protection, referral, assignment, escalation, and verified closure.
